These Terms of Service (“Terms”) are a legal agreement between you and Pairox Pty Ltd(ACN 154 477 728), a company incorporated in New South Wales, Australia (“Pairox,” “we,” “us,” or “our”). We operate the Healogy.ai platform (“Platform”), which provides AI-generated spiritual wellness content and connections with independent practitioners (“Services”).
By creating an account, clicking “I Agree,” or using Healogy.ai, you agree to these Terms. If you do not agree, do not use the Platform. We store your acceptance timestamp and version accepted for legal compliance.
These Terms incorporate by reference our: Privacy Policy; Medical Disclaimer; Karta Terms; Refund Policy; and Community Guidelines. In case of conflict, these Terms govern service use, while specialized documents govern their specific domains.
You must be 18 years or older to use the Platform. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. We may use age verification methods, including document upload or third-party verification services, for certain features or if we suspect age misrepresentation. If we learn that an account belongs to someone under 18, we will terminate the account and delete all personal information as required by law, except where retention is legally obligated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us at security@healogy.ai of any unauthorized use or security breach. We are not liable for any loss or damage arising from your failure to secure your account.
You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate and complete. Inaccurate information may result in inaccurate AI outputs, failed payments, or service disruptions for which we are not responsible.
AI-Generated Spiritual Content. Healogy.ai provides AI-generated spiritual, wellness, and reflective content including cosmic DNA charts, astrological readings, tarot insights, and guided reflections. All AI Content is generated by artificial intelligence systems, not human spiritual advisors. AI Content is provided for entertainment, self-reflection, and educational purposes only.
Karta Marketplace.The Platform facilitates live video sessions with independent practitioners (“kartas”). Kartas are independent contractors, not employees, agents, or representatives of Pairox. We do not supervise, direct, or control karta services. All Karta Services are provided directly by kartas, and Pairox is not a party to the practitioner-user relationship. See our Karta Terms for practitioner-specific obligations.
Community Features. The Platform includes community features such as belief system directories, blog posts, and user testimonials. These features are provided for community engagement and information sharing and do not constitute professional advice or platform endorsement of any views expressed.
Non-Medical, Non-Legal, Non-Financial Nature. All Services, including AI Content and Karta Services, are not medical, legal, financial, or professional advice. They are not substitutes for professional care. If you are experiencing a medical emergency, mental health crisis, or need legal or financial advice, contact a qualified professional immediately. AI Nature Disclosure.All AI Content is labeled “Generated by AI” at the point of creation. AI systems produce probabilistic outputs based on pattern recognition, not deterministic truths. AI Content may contain errors, inconsistencies, outdated information, or content that does not apply to your specific situation. We do not guarantee the accuracy, completeness, or usefulness of any AI Content.
No Reliance. You agree not to rely on AI Content for decisions regarding your health, safety, finances, relationships, legal matters, or other significant life decisions. AI-generated content is for reflection and entertainment, not direction for life decisions. You are solely responsible for how you interpret and act on AI Content.
Intellectual Property. Under current US Copyright Office guidance, works generated solely by AI without sufficient human creative input are not protected by copyright. This means purely AI-generated elements of cosmic DNA charts likely lack copyright protection, though your original selections, annotations, or arrangements may qualify for limited protection. You receive a personal, non-exclusive, non-transferable license to use your generated content for personal, non-commercial purposes. Commercial use requires our prior written consent.
State-Specific Disclosures. For users in California, Colorado, and Illinois: This service uses generative artificial intelligence. All AI-generated communications are clearly labeled as such. No AI-generated content constitutes medical advice, diagnosis, or treatment.
Auto-Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled. By subscribing, you consent to automatic recurring billing. We will present auto-renewal terms clearly before you complete your purchase.
Cancellation.You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not provide partial refunds for unused portions of a billing period unless required by law. If you signed up online, you can cancel online — no phone call required.
Renewal Notices.For annual subscriptions, we will send a renewal notice 3–15 days before the renewal date with the renewal price and a link to cancel.
EU/UK Cooling-Off. If you are in the European Union or United Kingdom, you have a 14-day right of withdrawal from the date of subscription. If you begin using premium services immediately, you acknowledge that you lose this right once performance begins. Withdrawal requests should be sent to privacy@healogy.ai.
Price Changes.We may change subscription prices with 30 days’ advance notice. If you do not agree to a price change, you may cancel before the change takes effect.
Wallet. Wallet purchases are prepaid balances for in-app use. Wallet balances are non-refundable except where required by law.
Pairox Pty Ltd is a technology company that operates the Platform to connect users with independent kartas. We do not directly offer, sell, or provide any spiritual guidance, astrological advice, or healing services.
No Endorsement or Verification.We do not verify, endorse, or guarantee any karta’s qualifications, credentials, advice, or services. Kartas are independent contractors operating their own practices. Platform vetting, ratings, or profile badges do not constitute qualification verification or professional endorsement. Kartas may choose to complete identity verification through a third-party provider; where shown, an identity-verification badge confirms only that a government-issued identity document was checked, and does not verify qualifications, credentials, or the quality of any service.
No Platform Liability for Karta Conduct. Pairox Pty Ltd is not liablefor any advice, action, omission, or conduct of any karta. All karta services are provided directly between you and the karta. Any disputes regarding karta services should be directed to the karta or reported through our Help → Tickets system for potential platform-level review.
US Intermediary Protection.For users in the United States, the Platform is an “interactive computer service” under 47 U.S.C. § 230. We are not the publisher or speaker of content provided by kartas or other users.
Your Content. You retain ownership of User Content you submit. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote that content on the Platform for the purpose of operating and improving our Services.
Prohibited Content. You may not submit content that: infringes intellectual property rights; is defamatory, harassing, or hateful; depicts or promotes violence, self-harm, or illegal activity; constitutes child sexual abuse material; impersonates another person; or violates any applicable law. We reserve the right to remove content and suspend accounts for violations.
Reporting. To report infringing or illegal content, email privacy@healogy.ai with the URL, description, and your contact information. We will respond within 48 hours.
DMCA. For copyright claims under the US Digital Millennium Copyright Act, send a written notice to our designated agent at privacy@healogy.ai including: identification of the copyrighted work; identification of the infringing material; your contact information; a statement of good faith belief; and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
Shared Cosmic DNA Cards. When you share cosmic DNA cards via public deep-links, those cards may remain accessible on third-party platforms (social media, messaging apps) even after you delete them from Healogy.ai. We cannot delete content from third-party servers. You are responsible for removing shared content directly from those platforms.
Platform IP. Healogy.ai trademarks, software, designs, algorithms, and original content are owned by Pairox Pty Ltd or its licensors. You may not use our trademarks without written permission.
Your Content. You retain rights to your own submitted User Content, and grant us the limited license described in Section 8.
AI Output. As described in Section 5, purely AI-generated elements likely lack copyright protection under current law. Your original creative input (selections, annotations, custom prompts) may qualify for limited protection. You receive a personal-use license to AI-generated content; commercial use requires our prior written consent.
Account Deletion. You may delete your account at any time through your account settings or by emailing privacy@healogy.ai. Upon deletion request, we will begin removing your personal data within 30 days.
What We Delete. We delete your profile, account data, saved preferences, session history, and generated content from our active systems.
What We Retain. After you delete your account (or after the 30-day grace period for a deletion request), we permanently erase or anonymize your personal data, except where the law requires us to keep specific records for a fixed period, or where we have a legitimate, narrowly-scoped need. We keep only the minimum necessary, and we anonymize or pseudonymize wherever possible. Specifically:
Retained data is anonymized or pseudonymized where possible. We do not retain data “just in case”: each carve-out above maps to a specific legal obligation or a defined, time-limited need.
Your data, and the right to a copy (data portability). You can ask us for a copy of the personal data we hold about you at any time. We provide it in a machine-readable format— a ZIP archive containing a structured JSON file (export.json) plus a plain-language PDF summary — delivered over a secure download link available for 7 days. Signed-in users can request this from Settings → Privacy → Request my data; we respond to verified requests within 30 days. Shared Content Limitations. Deleting your account invalidates public deep-links to your shared cosmic DNA cards, but we cannot remove content that has been copied or shared to third-party platforms. See Section 8.5.
Platform Termination. We may suspend or terminate your account for: violations of these Terms or the Community Guidelines; fraudulent activity; illegal conduct; or prolonged inactivity. We will notify you by email unless prohibited by law.
You agree to indemnify, defend, and hold harmless Pairox Pty Ltd, its affiliates, officers, directors, employees, agents, and kartas from any claim, loss, or cost (including reasonable legal fees) arising from: your User Content; your conduct on the Platform; your violation of these Terms; your violation of any third-party right; fraudulent payment disputes initiated by you; or platform abuse causing downtime or harm.
This indemnity does not apply to claims arising from Pairox’s gross negligence or wilful misconduct. This indemnity survives termination of these Terms.
To the maximum extent permitted by law, Pairox Pty Ltd’s total liability arising from your use of Healogy.ai is limited to the greater of AUD 5,000 or the total amount you paid to Healogy.ai in the 12 months preceding the event giving rise to the claim.
Exclusions. This cap does not apply to: fraud or wilful misconduct; statutory non-excludable liabilities (including Australian Consumer Law consumer guarantees, GDPR breaches, and mandatory consumer protection rights); personal injury or death; or breaches of confidentiality.
Indirect Damages. Neither party is liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of revenue, loss of opportunity, or reputational harm, even if advised of the possibility.
Mandatory Rights Preserved. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010), the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, the California Consumer Privacy Act, or equivalent local consumer-protection law in your jurisdiction.
Direct Resolution. If you have a dispute with us, please contact privacy@healogy.ai with a clear description. We will respond within 10 business days and attempt to resolve the matter in good faith.
Mediation. If direct resolution fails, either party may request mediation through the Resolution Institute (Australia) or a mutually agreed equivalent institution. Each party bears its own mediation costs.
Arbitration (US users). For users in the United States, disputes may be resolved through binding arbitration under the AAA Consumer Arbitration Rules. The arbitration will be conducted in English. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@healogy.ai. Small claims court disputes are exempt from arbitration.
Class Action Waiver (US users). To the maximum extent permitted by US law, you agree to resolve disputes on an individual basis and waive any right to participate in class, collective, or representative actions. If this waiver is found unenforceable, the arbitration agreement shall be severed for that dispute.
EU/UK Consumers. If you are a consumer in the European Union or United Kingdom, you may bring claims in the courts of your country of residence. Mandatory consumer protection laws of your jurisdiction apply to the extent they cannot be contracted away.
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles, except that if you are a consumer in the EU, UK, or California, the mandatory consumer protection laws of your jurisdiction apply to the extent they cannot be contracted away.
